Do not get deceived when looking for a job abroad through an intermediary!




In cooperation with the International Labour Organization and the International Trade Union Confederation, addressing issues related to the protection of the rights of Ukrainian migrant workers, the Federation has joined the network of the trade union structures of the European Trade Union Confederation — UnionMigrantNet (counseling and contact points for migrants) and offers citizens of Ukraine new opportunities to prevent and minimize the negative facts associated with the performance of the work duties in the host country.





The economic activity of the intermediaries, recruiters, employment agencies that provide employment assistance services abroad, in accordance with the requirements of the legislation of Ukraine is subject to licensing.

The licensee (intermediary, recruiter, employment agency) is obliged to carry out the intermediation activities in employment abroad within the foreign economic agreements (contracts) on the provision of employment intermediation services abroad concluded with a foreign business entity, in accordance with the applications and orders on vacancies made by foreign employer. Mandatory annex to the agreement (contract) is a draft employment agreement certified by a foreign employer. 

It is prohibited to offer migrant workers assistance in their employment abroad in activities that are prohibited or for which liability is provided in accordance with the legislation of Ukraine, the country of employment or international norms.

The provision of services to migrant workers is carried out after the conclusion of an agreement with the licensee on the provision of employment intermediation services abroad. Prior to concluding this agreement, the licensee shall provide free of charge and reliable information about working conditions and living conditions in the country of employment.

The licensee must check that migrant workers have the documents confirming their qualifications required to perform the relevant work or provide services in accordance with international standards and/or the requirements of the legislation of the country of employment;

Licensees are not entitled to receive payment from migrant workers who are provided with such services until the signing of the act of provided services.

Before leaving for the state of employment, the migrant worker is issued a draft employment agreement (contract) by the intermediary/recruiter/employment agency, certified by a foreign employer, which is set out in Ukrainian and one or more languages ​​used in the host country, and contains obligations, which are undertaken by a foreign employer, in particular regarding:

The licensee must have its own website and provide migrant workers who have been provided with employment intermediation services abroad, information on legal and social protection and the mechanism of voluntary participation in compulsory state social insurance in Ukraine.

On June 16, 2020, the Verkhovna Rada adopted in the first reading the draft law №2365 “On Protection of Migrant Workers and Combating Fraud in Employment Abroad”, which proposes to prohibit intermediaries, recruiters, employment agencies from charging citizens any fees, commissions and other rewards for intermediation in employment abroad.
